General terms and conditions

Ideal Services Ltd (hereinafter referred to as Ideal) is the franchisee of the Avis brand in Estonia. These general terms and conditions apply to all short-term rental agreements concluded with Ideal.

1. Rental period

  • The lessee leases the vehicle for the period specified in the lease agreement. The rental period may be extended by agreement of the parties. Before the extension of the rental agreement, Ideal shall provide the Renter with a price list for the extension of the rental period and the Renter shall confirm his acceptance of the price list by sending an e-mail. The minimum rental period shall be five days.

2. Delivery and return of the vehicle

  • The vehicle shall be delivered and returned to the address Jaunmoku iela 34, Riga, Latvia. Delivery and return shall take place on working days from 10.00 to 12.00, except in cases agreed separately by the parties.
  • The Renter must be present during the detailed vehicle familiarisation by an Ideal employee.
  • When delivering the vehicle, the lessee must make sure that the vehicle is in good roadworthy condition and free from defects, and that the interior of the vehicle is clean. The hirer must check that the vehicle’s technical data sheet records any damage that was visible on the vehicle at the time of delivery. Subsequent complaints about damage to the vehicle will not be accepted and will be deemed to have been caused by the Renter and will be compensated by Ideal.
  • The Renter must return the vehicle at the time and place specified in the rental contract. Ideal agrees that the return of the vehicle may be delayed by up to one hour, after which an additional charge of one day will apply.
  • If the Lessee fails to return the Vehicle at the agreed time and place or immediately upon early termination of the Contract, Ideal shall have the right to declare the Vehicle lost and to exercise all statutory rights to recover possession of the Vehicle, including the Lessee authorising Ideal to take immediate possession of the Vehicle (including removal). If Ideal incurs additional expenses in connection with the foregoing, the Lessee shall reimburse Ideal for such expenses. Upon removal of the vehicle, Ideal shall use its best endeavours to ensure the preservation of the items left in the vehicle by the Lessee. However, Ideal shall not be liable for any damage or loss which may occur to them during or after the removal.
  • The lessee must return the vehicle in the same condition as when it was handed over to the lessee, except for normal wear and tear. The Lessee must return the vehicle together with all tyres, equipment and documents to Ideal personnel at the place where the vehicle was rented or at the place specified in the rental contract.
  • The lessee receives the vehicle with a full tank of fuel and must also return the vehicle with a full tank of fuel. If the vehicle is not returned with a full tank of fuel, the Lessee shall pay the fee set out in clause 4.2.10.
  • When returning the vehicle, the hirer must clean the passenger compartment, empty the sewage tank and the toilet tank. Failure to do so shall result in the payment of the cleaning fee referred to in point 4.2.8.

3. Requirements for using the vehicle

  • As the user of the vehicle specified in the rental contract and holder of a valid driving licence, the lessee must be aware of and comply with the applicable road traffic rules, and must undertake to pay any fines or other costs incurred if the lessee infringes the road traffic rules.
  • A person who:
    • is named in the rental contract, has a valid driving licence and is at least 25 years old;
    • another person who Ideal, at the lessee’s request, has specified in the rental agreement and who meets the requirements for a driver. The Lessee is fully responsible for this person and is obliged to check that this person complies with the Rental Agreement and the General Terms and Conditions.
  • The vehicle must not be used:
    • for the carriage of passengers for hire or reward (e.g. for the provision of carriage or taxi services);
    • towing another vehicle or trailer
    • transporting goods in breach of customs rules or other illegal activities
    • a driver under the influence of alcohol, drugs or other illegal substances;
    • a driver who does not hold a licence for the relevant category of vehicle;
    • competitions or training for such competitions;
    • for driving training;
    • for off-road driving.
  • Smoking is prohibited inside the vehicle. If this requirement is violated, the Renter must pay the cleaning fee mentioned in point 2.7.
  • When leaving the vehicle, the renter must take the necessary precautions (e.g. lock the vehicle doors) to prevent accidents or theft. The Renter must also take the keys and documents (registration certificate and other documents) with him when leaving the vehicle.

4. Max

  • The tenant must pay the rent and a security deposit upon conclusion of the rental agreement. The security deposit is payable five working days before the rental date and amounts to EUR 900-1200. The security deposit is refundable if everything is in order with the vehicle after the rental.
  • The tenant must pay Ideal:
    • the rental charge according to the applicable rates, calculated on the basis of the number of rental days and the number of kilometres driven. If the vehicle is returned more than one hour after the agreed return time specified in the rental contract, the lessee shall pay for the rental period calculated on the basis of the actual return time. If the lessee returns the vehicle before the end of the rental period, Ideal has the right to demand payment of the full rental fee specified in the rental agreement;
    • any additional costs (insurance, delivery charges, etc.) plus the value added tax provided for by the laws and regulations to which the lessee has agreed when signing the lease agreement;
    • the refuelling charge if the lessee fails to comply with the obligations laid down in paragraph 7;
    • a fine for driving under the influence of alcohol, for breaching traffic rules or for other illegal acts, if the fine is collected from Ideal, including if Ideal is fined for allowing a person not entitled to drive to drive;
    • if the lessee has the appropriate consent from Ideal to leave the Baltic States and the vehicle becomes unroadworthy outside the Baltic States, the lessee shall bear the costs of returning the vehicle to Ideal’s rental office in the Republic of Estonia. The rental contract shall be valid until the vehicle is transferred to Ideal’ s possession;
    • Parking fines, traffic offence fines and default interest submitted by Ideal, as well as charges for towing a vehicle to a parking place due to improper parking or for any other reason, and a fine or damage administration fee of €35 imposed by Ideal ;
    • an emergency cleaning fee of €200 if the hirer has smoked in the interior of the vehicle or if the interior is so dirty that dry cleaning is needed to restore it to its pre-rental condition;
    • a fine of €200 for failing to clean the vehicle or empty the toilet and sewage;
    • a fine of €200 for transporting animals in a vehicle, which is prohibited;
    • if the vehicle is not returned with a full tank of fuel, the fine is €2.5 per litre.
  • The tenant pays Ideal by bank transfer. If the rent or other payments stipulated in the rental agreement and/or the general terms and conditions are not paid on time, the lessee shall pay default interest of 0.2% of the unpaid amount for each day of delay. In the event of late payment, the default interest and penalty shall be paid first, followed by the principal amount. In the event that the lessee fails to comply with the requirements of the lease agreement and/or fails to comply with them in a timely manner, Ideal shall have the right to publish information about the lessee in credit registers (including but not limited to the database maintained by Creditinfo and the Ideal Global Database).

5. Responsibility

  • The Hirer assumes full responsibility for the preservation of the Vehicle and for any damage to the Vehicle (including the risk of accidental destruction and damage to the Vehicle) occurring before the Ideal employee inspects and accepts the Vehicle.
  • If the vehicle is found to be defective during the rental period, or is involved in an accident or vandalised, the renter must inform Ideal immediately and follow Ideal’s instructions on how to proceed. The Hirer must not repair any defects which have become apparent to the vehicle himself. In the event of a breach of this provision, the Renter must compensate Ideal for the damage caused (e.g. if the original parts of the vehicle have been replaced by parts of inferior quality).

6. Insurance

  • Ideal insures the vehicle used by the lessee against damage that may be caused to third parties in accordance with applicable law. In the event of an insured event, the terms and conditions of insurance agreed between Ideal and its insurer shall apply. The Renter must consult the relevant terms and conditions of the vehicle insurance at the Ideal service counter before concluding the rental contract.
  • In the event of an insured event, the lessee shall be liable to Ideal to the extent of the excess. The amount of the excess depends on the group to which the vehicle belongs and on what is stipulated in the rental contract. The lessee may reduce the excess amount by paying an additional charge per day of the rental period according to the group of the vehicle chosen by the lessee.
  • Notwithstanding paragraph 2, the following damage is not covered:
    • damage to the vehicle’s interior, steering system, underbody or engine compartment, driving with burst tyres, damage caused by snow or ice (e.g. snow or ice falling from the roof of a building) or damage caused by driving off roads not intended for vehicular traffic.
    • if the vehicle is stolen and the lessee does not take the vehicle documents and/or the key with him when he leaves the vehicle, as specified in point 5. If, in the event of theft of the vehicle, the lessee returns the vehicle keys and documents (registration certificate) to Ideal and proves that he has taken the necessary precautions to ensure the security of the vehicle, the lessee’s liability shall be limited to the amount of the excess.

7. What to do in the event of an accident

  • The hirer and any driver authorised to use the vehicle must take all measures to protect the interests of Ideal and the insurer in the event of an accident during the hire, including:
    • find out the names and contact details of all parties involved in the accident, as well as the names and contact details of possible witnesses;
    • not admit fault or liability without the prior consent of Ideal;
    • leaving the vehicle unattended or failing to take measures to protect its safety after an accident;
    • immediately inform Ideal and, if necessary, the police of the accident or theft and remain at the scene until the police have given permission to leave the vehicle;
    • prepare a letter of explanation to Ideal about the accident or theft and submit it to Ideal within 24 hours after the accident or theft occurred.

8. Amendment and Termination of the Agreement

  • The rental contract can be renewed by email.
  • The rental contract ends on the last day of the rental period specified in the contract, when the lessee returns the vehicle.
  • Ideal has the right to terminate the lease early if the lessee is in material breach of the agreement. A material breach includes, but is not limited to:
    • the lessee uses the vehicle for a purpose other than that for which it was intended, including in the manner set out in paragraph 3;
    • the Lessee fails to return the vehicle on time and fails to inform Ideal in writing or by email of the late return of the vehicle.

9. Processing of personal data

  • Ideal processes the Tenant’s personal data on the basis of and in accordance with the grounds set out in applicable law. Ideal’s principles for processing personal data can be found in more detail at Ideal’ s offices, at the rental point and on the website: avis.ee; myavis.ee; budget.ee.

10. Other provisions

  • The General Terms and Conditions shall form an integral part of the Rental Agreement between Ideal and the Lessee.
  • The Rental Agreement and the General Terms and Conditions are based on and governed by the laws of the Republic of Estonia. 10.3 All disputes, disagreements and complaints arising out of the performance or interpretation of the Contract shall be settled by negotiation between the Parties.

If no agreement is reached, the dispute is settled at Harju County Court.
